End User License Agreement.

Subject to your compliance with this Agreement, POLYMORPH grants you a limited, personal, non-exclusive, non-transferable and revocable license to install and use the Software for its intended purpose.

The Software is licensed, not sold.

Except where expressly permitted by applicable law, you may not:

• sell, sublicense, rent, lease or redistribute the Software;
• provide the Software as a hosted or commercial service for third parties;
• reverse engineer, decompile or disassemble the Software;
• remove or alter copyright, trademark, attribution or proprietary notices;
• bypass technical restrictions, licensing controls, account limitations or usage restrictions;
• attempt to gain unauthorized access to POLYMORPH systems, APIs, servers or other users' accounts;
• use modified or unauthorized versions of the Software to circumvent service limitations.

Nothing in this Agreement limits rights that cannot legally be excluded under applicable law.

Some features of the Software require a POLYMORPH AWAKE account.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity performed through your account.

You must not:

• share account authentication credentials with unauthorized persons;
• attempt to access another user's account;
• impersonate another user;
• interfere with another user's use of the service;
• circumvent account, entitlement, companion-slot, credit or product restrictions.

You are responsible for ensuring that information supplied during registration and activation is accurate.

POLYMORPH AWAKE is designed to interact with Second Life.

Second Life is operated by Linden Research, Inc. ("Linden Lab").

POLYMORPH is an independent developer and is not affiliated with, endorsed by, sponsored by or acting on behalf of Linden Lab.

Your use of Second Life remains subject to Linden Lab's own Terms of Service, policies and technical restrictions.

You are solely responsible for ensuring that your use of AWAKE and any associated Second Life accounts complies with applicable Linden Lab rules.

Nothing in this Agreement grants you any rights in Second Life, Linden Lab trademarks, virtual assets or services.

Certain AWAKE functions require the Software to authenticate a companion avatar with Second Life.

Where Second Life credentials are required, you are responsible for ensuring that:

• you are authorized to use the relevant account;
• the credentials belong to an account you control or are otherwise legally authorized to operate;
• your use complies with Linden Lab requirements.

You must not use AWAKE to access a Second Life account without authorization.

POLYMORPH may implement technical safeguards designed to protect credentials and authentication data, but no electronic system can be guaranteed to be completely secure.

AWAKE uses artificial intelligence services to generate some companion responses and behaviors.

AI-generated content may:

• be inaccurate;
• be incomplete;
• be inappropriate in a particular context;
• fail to reflect your intentions;
• vary between requests;
• occasionally produce unexpected results.

AI-generated content should not be relied upon as professional medical, legal, financial, psychological or other professional advice.

You remain responsible for how you use the Software and for interactions performed through avatars under your control.

POLYMORPH does not guarantee that AI-generated content will always be accurate, appropriate, available or error-free.

You retain responsibility for content you provide to or through the Software.

You represent that you have the necessary rights and permissions to provide such content.

You must not use the Software to knowingly:

• violate applicable law;
• infringe intellectual property rights;
• engage in fraud or impersonation;
• obtain unauthorized access to accounts or systems;
• distribute malware or malicious code;
• interfere with the operation of the Software or related services.

Use of AWAKE must also comply with applicable Second Life rules and policies.

The collection and processing of personal data in connection with AWAKE is governed by the POLYMORPH AWAKE Privacy Policy.

The Privacy Policy forms part of the terms governing your use of the service.

POLYMORPH intends to process personal data in accordance with applicable data-protection laws, including the General Data Protection Regulation where applicable.

The Software is designed with privacy as a priority. Details concerning what data is processed, its purpose, retention and user rights are described separately in the Privacy Policy.

This EULA does not replace the Privacy Policy.

AWAKE may be offered in different editions, licenses, plugins or packages, including features intended only for users meeting specific eligibility requirements.

Features available to you depend on the products and entitlements associated with your account.

Purchasing one product does not automatically grant access to features associated with another product unless expressly stated at the time of purchase.

POLYMORPH may use technical controls to enforce product entitlements.

Certain AWAKE editions or optional features may be intended exclusively for adult users and/or use within adult-designated Second Life environments.

By enabling or using adult features, you represent that:

• you meet the minimum age requirements applicable to those features;
• such use is lawful in your jurisdiction;
• you comply with relevant Second Life maturity classifications and policies.

POLYMORPH does not authorize minors to use adult-only features.

Certain AWAKE products may enable an account holder to make companion avatars available for paid interactions with other Second Life users.

POLYMORPH does not act as employer, agency, broker or representative of users participating in such interactions.

Users remain responsible for:

• setting their own rates where supported;
• determining whether participation is appropriate and lawful;
• complying with Second Life rules;
• interactions with other users;
• taxes or other obligations that may apply to them.

Any Linden Dollar transaction remains subject to the Second Life platform and applicable Linden Lab rules.

POLYMORPH does not guarantee earnings, availability of customers or any specific financial result.

Certain Software functions consume AWAKE credits.

AWAKE credits are service-use units and:

• are not legal currency;
• are not Linden Dollars;
• do not represent a bank account, stored-value account or financial instrument;
• have no cash value outside the AWAKE service;
• cannot be exchanged for money unless expressly required by applicable law.

Credit consumption, grants and balances may be governed by the product or service terms applicable at the time they are obtained.

Except where required by applicable consumer law, used credits are non-refundable.

AWAKE may offer a limited demonstration version.

Demo access may be subject to:

• time limits;
• feature restrictions;
• account eligibility requirements;
• one-time claim restrictions;
• restrictions on purchases, credits, plugins or commercial features.

Attempts to circumvent demo restrictions may result in termination or suspension of access.

POLYMORPH may release updates, bug fixes, security improvements or feature changes.

Updates may be required to maintain compatibility with:

• POLYMORPH services;
• Second Life;
• third-party APIs;
• operating-system changes;
• security requirements.

POLYMORPH does not guarantee indefinite compatibility with obsolete versions of the Software.

AWAKE requires access to external networks and services.

Availability may depend upon systems outside POLYMORPH's control, including:

• Internet connectivity;
• Second Life services;
• AI providers;
• hosting providers;
• operating-system services;
• third-party APIs.

POLYMORPH cannot guarantee uninterrupted availability of third-party systems.

Temporary interruption of such systems does not necessarily constitute a defect in the Software.

The Software and/or its installer may be distributed without a commercial digital code-signing certificate.

As a result, Microsoft Windows, Microsoft SmartScreen, antivirus software or other security products may display warnings concerning an unknown or unverified publisher.

Such warnings are generated by the relevant operating system or security provider and are not controlled by POLYMORPH.

You should obtain the Software only from an official POLYMORPH distribution source.

You should not install or execute a copy if:

• its origin cannot be verified;
• you obtained it from an untrusted third party;
• the package appears to have been modified;
• your security software identifies evidence of actual malicious modification.

The absence of a commercial code-signing certificate does not grant permission for third parties to modify or redistribute the Software.

The Software contains or uses third-party open-source components.

Applicable copyright notices and license terms are provided with the Software in THIRD-PARTY-NOTICES.txt and associated third-party license files.

Those components remain subject to their respective licenses.

Nothing in this Agreement restricts rights granted to you directly under an applicable open-source license.

Except for third-party components identified separately, all rights, title and interest in AWAKE, including its software, design, branding, documentation and associated intellectual property, remain the property of POLYMORPH and/or its licensors.

This Agreement does not transfer ownership of any POLYMORPH intellectual property to you.

"POLYMORPH" and "AWAKE" and associated branding may not be used in a manner that implies authorization, sponsorship or affiliation without permission.

POLYMORPH may suspend or terminate access to online services where reasonably necessary, including in cases involving:

• material breach of this Agreement;
• fraud;
• unauthorized access;
• circumvention of technical restrictions;
• abuse of POLYMORPH infrastructure;
• threats to system security;
• legal or regulatory requirements.

Where appropriate and reasonably possible, POLYMORPH may provide notice before suspension.

Termination does not affect rights that accrued before termination.

To the maximum extent permitted by applicable law, the Software and related services are provided on an "as is" and "as available" basis.

POLYMORPH does not warrant that:

• the Software will operate without interruption;
• the Software will be error-free;
• every feature will remain permanently available;
• the Software will be compatible with every computer configuration;
• third-party services will remain available;
• AI-generated output will always be accurate or appropriate.

Nothing in this Agreement excludes warranties or consumer rights that cannot legally be excluded.

To the maximum extent permitted by applicable law, POLYMORPH shall not be liable for indirect, incidental, special, consequential or similar damages arising from use or inability to use the Software, including loss of:

• virtual assets;
• account access;
• data;
• profits;
• expected income;
• business opportunities.

POLYMORPH is not responsible for actions taken independently by:

• Linden Lab;
• other Second Life users;
• AI providers;
• Internet providers;
• operating-system vendors;
• other third-party services.

Nothing in this Agreement limits liability where such limitation is prohibited by applicable law, including liability that cannot legally be excluded for intent, gross negligence, personal injury or mandatory consumer protections.

You are responsible for maintaining appropriate backups of information under your control.

Although POLYMORPH may implement safeguards intended to protect service data, no system can guarantee against all data loss, hardware failure, network failure or third-party service interruption.

Your rights under this Agreement are personal.

You may not transfer or assign this Agreement or your Software license to another person except where expressly permitted by POLYMORPH or required by applicable law.

POLYMORPH may transfer its rights and obligations in connection with a legitimate transfer of the relevant business or service, subject to applicable law.

POLYMORPH may update this Agreement when reasonably necessary to reflect:

• changes to the Software;
• new features;
• legal requirements;
• security requirements;
• changes to third-party platforms.

Material changes applicable to online services will be communicated through an appropriate channel where required by law.

Where applicable law requires renewed consent, continued use alone will not substitute for consent.

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by law.

The invalid provision shall be interpreted or replaced as closely as legally possible to achieve its intended purpose.

Failure by POLYMORPH to enforce a provision of this Agreement does not waive the right to enforce that provision later.

This Agreement shall be governed by the laws of Italy, without prejudice to mandatory consumer-protection rules applicable in the country where a consumer normally resides.

Where mandatory law grants consumers the right to bring proceedings before courts in their place of residence, nothing in this Agreement removes that right.

For disputes not subject to mandatory consumer jurisdiction, the competent courts shall be those determined under applicable Italian law.

This Agreement, together with the Privacy Policy and any specific terms expressly applicable to a purchased AWAKE product or service, constitutes the agreement governing your use of the Software.

If a specific mandatory legal requirement conflicts with this Agreement, that mandatory requirement prevails.
